The Court of Appeal is among the highest-level judiciary systems in Zambia and with international connections and national representations, Dr. Mahtani had high expectations of justice and transparency from this court. As it is safe to say that this transparency was maintained by the court during the entire timeline of case proceedings. Justice Mwinde took over the case of Portland Cement Zambia on behalf of the Court of Appeal. Justice Mwinde from the court announced directly that since the case has stretched for more than a decade and the final decision from the lower court has been controversial, the higher Court of Appeal will announce its totally based on the available evidences, testimonials, facts and other details.
At last, the date was announced when final case verdict on the Portland Cement Zambia would be given and it was 31st January 2019. During the first half of the court session, justice Mwinde placed the final hearing in which he reiterated the various evidences and testimonials that were evaluated and based on which final verdict was given. Justice Mwinde confirmed that Dr. Rajan Mahtani indeed made a payment of USD 250,000 which equals one billion kwachas to the Portland Cement Zambia limited in an official entry. This payment was made via Finsbury Investments, which is a holding company under Dr. Rajan Lekhraj Mahtani. Furthermore, the above amount was paid with interest and covered the value of the total share capital which Dr. Rajan Mahtani took over. Justice Mwinde also confirmed that the contents of the original agreement between shareholders were authentic and signed by the members associated with the factory. In the page number 663 of this original shareholders’ agreement, it was clearly established that Dr. Rajan Mahtani took over ownership of 58 percent shares of the Portland Cement Zambia after making the said payment which automatically gave him the power of attorney of the Portland Cement factory.
